What a North Haven Personal Injury Lawyer at Our Firm Handles

North Haven sits at the crossroads of I-91 and Route 5. That mix of highway traffic, retail corridors along Universal Drive, and dense residential streets produces a wide range of injury claims every year. Our North Haven personal injury attorneys represent clients hurt in:

Whatever caused the injury, the same question drives every case: who failed to act reasonably, and what did that failure cost you? We build the answer to that question with medical records, police reports, and, when needed, our own investigators.

Premises Liability Claims: When a North Haven Property Owner Is Responsible

Not every personal injury happens on the road. Many of the calls we get from North Haven come from people hurt on someone else’s property, whether that is a fall in a store on Universal Drive, a dog bite at a neighbor’s house, or an injury in an apartment complex hallway that was never repaired.

Connecticut law ties a property owner’s responsibility to why you were on the property in the first place. Customers and other business visitors, known as invitees, are owed a duty of reasonable care, and owners are expected to inspect their property regularly and fix or warn about hazards.

Guests you invite to your home or property for social reasons are treated the same as business visitors under Connecticut law. People who are there with permission but were not invited, known as licensees, are owed a warning about hidden dangers the owner already knows about.

To win a premises liability claim, you generally have to show the owner created the hazard, or knew (or reasonably should have known) about it and failed to fix it or warn visitors in time.

Common Causes of Premises Liability Claims

North Haven premises claims we handle include:

  • Slip and fall injuries on wet floors, ice, or uneven pavement
  • Poorly lit stairwells or parking lots
  • Defective or missing handrails
  • Inadequate security at apartment complexes and hotels

If a fall or property-related injury happened to you in North Haven, our premises liability team can walk through what the property owner owed you and whether that duty was met.

Connecticut’s Deadline to File a North Haven Personal Injury Claim

Connecticut law does not give you forever to bring a claim. Under Connecticut General Statutes § 52-584, you generally have two years from the date your injury was, or reasonably should have been, discovered to file a lawsuit for an injury caused by negligence. You also generally cannot file more than three years after the act that caused the injury, regardless of when you discovered it.

Shorter deadlines can apply. For example, if a town, city, or state road or sidewalk defect caused your injury, you generally must give written notice within 90 days. Other situations can also change these time limits.

Wrongful death claims also follow a different clock: two years from the date of death, and no more than five years from the wrongful act itself, under Connecticut General Statutes § 52-555. A few exceptions exist. For example, there is no deadline if the person at fault was convicted of certain homicide crimes.

Navigating Insurance Claims and Auto Repairs in North Haven

Following a motor vehicle collision along major corridors like I-91 or Route 5 in North Haven, insurance adjusters often move quickly to minimize payout amounts. They may push you to use specific auto repair shops, advocate for aftermarket replacement parts (parts not made by your car’s manufacturer), or request recorded statements before you have fully assessed your injuries.

Under Connecticut law, you have the right to choose your own repair shop. You generally do not have to give a recorded statement or sign a broad medical release for the other driver’s insurance company. Your own insurance company may require some cooperation under your policy, so talk with a lawyer before you agree to either. Exercising these protections early helps safeguard your physical recovery and financial interests.

Our local attorneys and staff handle communications with insurance representatives for you, working to protect your rights during the claims process.

Frequently Asked Questions

Q: How much does it cost to hire a North Haven personal injury lawyer?

A: It costs nothing upfront. We handle personal injury cases on a contingency fee basis, which means our fee comes out of your settlement or verdict, and only if we recover money for you. The initial consultation is always free.

Q: What should I do if I was hurt on someone else’s property in North Haven?

A: Get medical attention even if you feel fine at first, report the condition to the property owner or manager, and take photos of the hazard before it can be fixed or cleaned up. Then contact us before you speak with the property owner’s insurance company, since insurers often use early statements to shift blame onto the injured person.

Q: Where will my North Haven injury lawsuit be filed?

A: Depending on where you and the other side live, a North Haven injury lawsuit may be filed in the Superior Court for the New Haven Judicial District, with the courthouse located at 235 Church Street in downtown New Haven. Our attorneys appear there regularly, which means we already know the local filing procedures and scheduling practices that can affect how quickly your case moves.

Q: Do I still have a case if I was partly responsible for my accident?

A: Possibly, yes. Connecticut’s modified comparative negligence rule under Connecticut General Statutes § 52-572h lets you recover damages as long as you were 50% or less at fault, though your compensation is reduced by your share of the blame. An honest early assessment of fault is one of the first things we walk through with new clients.

Know Your Rights and Responsibilities After an Auto Accident

After an auto accident, insurance companies immediately take steps to minimize claim costs. This generally starts off with efforts to steer victims to insurance company preferred auto body shops, pushing for imitation auto parts, and securing premature recorded statements or medical authorizations. As for auto repairs, the law is clear: Your Car, Your Choice. We recommend that you choose an auto body shop of your choice, and take any directive from an insurance company with great skepticism. Similarly, it is often against your interest and not required that you give a recorded statement or medical authorizations. We are here to guide you through this process, help you avoid the pitfalls, and work with you to discuss your rights and responsibilities after an auto accident.
