Why Clients in New Haven Choose Our Personal Injury Lawyers

When you are facing the prospect of filing a personal injury claim, choosing the right attorney to represent you can make all the difference in the outcome of your case. At Buckley Wynne & Parese, we understand what is at stake for our clients when they come to us for help. Many of them are facing financial losses that are insurmountable without compensation. Medical bills and lost wages can combine to put enormous financial strain on injury victims and their families.

Our clients choose us because we have the knowledge and experience it takes to advocate for them and help them protect their peace of mind and their families’ futures. We do not take every case we are presented with because we want to provide each of our clients with the care and attention they deserve, and we cannot do that if our resources are stretched too thin. Our focus is on the quality of the service we deliver to our clients, not on taking on the highest volume of cases possible.

One frustration many people have with attorneys is the feeling that they are being passed off to a person with little experience. Some attorneys delegate all their client communication to paralegals or junior attorneys, sometimes leaving clients feeling like their cases are not important. At Buckley Wynne & Parese, every case is assigned to a senior partner, so our clients get peace of mind that comes with knowing they are talking to an experienced attorney every time.

Although most personal injury cases settle before they reach the trial phase, your attorney should be ready and willing to litigate. It is true that reaching a settlement out of court is more cost-effective for everyone involved in a personal injury case, and avoiding court reduces the case timeline significantly. Even so, some personal injury cases cannot be resolved through negotiation or mediation, so the attorneys at Buckley Wynne & Parese are always ready to represent our clients in the courtroom.

Our law firm is built on legacy and excellence in the legal field. One of our founding attorneys, John F. Wynne, Jr., is a fourth-generation lawyer, continuing the family tradition established by his great-grandfather in 1881. We approach every case with that history behind us, determined to continue to serve our clients with the integrity and tenacity they deserve during some of the most vulnerable times of their lives.

Our office in New Haven is conveniently located at 685 State Street, allowing our clients to easily stop in to ask questions or discuss their cases at length in scheduled meetings. We are also available 24 hours per day by phone because we understand that legal emergencies happen, and they often happen outside of regular work hours.

How Personal Injury Cases Work in New Haven

To file a personal injury claim in New Haven, the situation must involve both liability and losses. For a personal injury case to be considered legitimate in the eyes of the law, the following statements must be true:

  • The allegedly liable party must have had a duty of care to the injured party.
  • The allegedly liable party must have breached that duty of care, whether through negligence, failure to act, or wrongful actions.
  • The injury in question must be a direct result of the allegedly liable party’s breach of their duty of care.
  • The injured person must have suffered actual, quantifiable losses because of the injury.

If a person is injured in an accident, but the injury does not result in real financial losses, such as medical expenses or lost wages from missing work, the injured person likely does not have a legitimate personal injury case. Although emotional distress and psychological trauma can be considered when negotiating a personal injury settlement, these nonmonetary damages are not, on their own, grounds for a personal injury claim.

Personal injury cases can result from a wide variety of scenarios in everyday life. The following are some of the most common cases for personal injury cases and the resulting legal claims:

  • Car accidents. Every time we get behind the wheel of a car or ride with another driver, we assume a significant safety risk. Many of us do not think about the dangers associated with car travel because it is ubiquitous in modern life, but the risk is always there. There are a few high-traffic roadways near New Haven, such as I-95 and I-91, that pose a particular accident risk. In 2025, New Haven reported a total of 1,417 injury-causing car accidents.
  • Premises liability accidents. Property owners and managers have a responsibility to make sure their properties are safe for visitors. When they neglect this responsibility, people can get hurt. One example of this would be a person tripping on an unmarked step on a sidewalk in front of a commercial building.
  • Medical malpractice. Doctors and other healthcare workers have a duty to provide care according to established standards. Failure to adhere to standards of care can result in injuries or death to patients.
  • Product liability. Sometimes, faulty products result in serious injuries to their users. A person may have a legitimate personal injury case related to product liability if they were injured by a product while using it according to its intended purpose.
  • Workplace injuries. New Haven workers who are injured on the job can file a compensation claim to offset their losses.

In Connecticut, many personal injury cases are handled by the Connecticut Superior Court. The Superior Court is housed in many locations around the state, according to established judicial districts. For personal injuries that occurred in New Haven, or for cases in which the defendant lives in New Haven, the initial claim should be filed at the New Haven Superior Court, located at 235 Church Street.

In a typical personal injury case, after the initial claim is filed, negotiations regarding a settlement can begin. If negotiations fail, the case can move to a trial phase, during which both sides are presented to a judge, who ultimately decides on the outcome of the case and awards any applicable damages. Personal injury damages can generally include the following:

  • Medical bills. A fair personal injury settlement should cover every medical bill associated with the incident, from an initial ambulance ride or emergency room care to the last physical therapy session. If an injury results in the need for ongoing care, those projected costs should be included, as well.
  • Lost wages. Serious injuries often result in long absences from work, leading to financial pressure and potentially job loss. In some cases, injury victims are permanently disabled or unable to return to the work they were doing before. Personal injury compensation should include all of the wages a victim has lost, as well as projected future wages if applicable.
  • Pain and suffering. Pain and suffering are standard elements of a personal injury settlement. This compensation is for both the physical pain of the injury and the psychological distress associated with the incident.

What to Do After an Accident in New Haven

Accidents that cause injuries are often traumatic events, and it can be difficult to determine what steps to take in the moment. The following are some things you should do immediately following an accident in New Haven:

  • Seek medical attention. In any accident scenario, your health and safety should be the top priority. If you are injured in New Haven, it is important to get a full medical evaluation. Some injuries are not immediately obvious, particularly after an event like a car accident, so you should go to a reputable hospital like Yale New Haven for an exam.
  • Notify authorities. If you are in a car accident or other public accident involving any property damage or the need for a police report, you should call the police to notify them of the situation if you are able to do so.
  • Document the scene. If you are medically stable and capable, you should take photos or videos of the scene of the accident. This photographic evidence can help you later when you file an insurance claim or a civil action for a personal injury.
  • Get witness contacts. Getting the names and contact information of anyone who witnessed the accident is also a good idea. You or your attorney may need to contact witnesses later to help support your version of events.
  • Hire a personal injury lawyer. Any time you need to pursue compensation for a personal injury, it is a wise decision to hire an experienced personal injury lawyer who has successfully handled cases like yours.

When you decide to pursue compensation for your losses, the first step is often to file a claim with the liable person or party’s insurance company. This consideration applies in many personal injury scenarios, including car accidents, medical malpractice incidents, and premises liability accidents. Your attorney can help you file this initial insurance claim, communicating with the insurance company on your behalf.

Sometimes, communication from an attorney is enough to demonstrate to an insurance adjuster that an injury victim is serious about pursuing compensation. Occasionally, this posture influences the insurance company to come back with an adequate settlement offer. In many cases, however, an initial offer from an insurance company is not enough to offset losses from an injury. This is why it is vital that you do not accept an insurance settlement offer without first consulting your lawyer.

At the end of the day, insurance companies are businesses. Their goal and purpose are to make money, and sometimes that means denying or underpaying claims that should be covered under their policies. If the liable party’s insurance company offers an insufficient settlement, your attorney can push back and try to negotiate for more compensation. If, as is often the case, the negotiations with the insurance company do not result in a satisfactory settlement, the next step is to file a personal injury claim.

Your attorney can file your personal injury claim with the New Haven Superior Court on your behalf. After the case is filed, the defendant will be notified of the action against them and given a chance to respond. Your attorney can work with the defendant or their legal representative to negotiate toward a reasonable settlement for your injuries. If no agreement can be made, the case moves to courtroom litigation in the trial phase, where a judge hears the arguments and delivers a verdict.

Know Your Rights and Responsibilities After an Auto Accident

After an auto accident, insurance companies immediately take steps to minimize claim costs. This generally starts off with efforts to steer victims to insurance company preferred auto body shops, pushing for imitation auto parts, and securing premature recorded statements or medical authorizations. As for auto repairs, the law is clear: Your Car, Your Choice. We recommend that you choose an auto body shop of your choice, and take any directive from an insurance company with great skepticism. Similarly, it is often against your interest and not required that you give a recorded statement or medical authorizations. We are here to guide you through this process, help you avoid the pitfalls, and work with you to discuss your rights and responsibilities after an auto accident.
